Send Fax — Terms of Use

1) Acceptance of Terms

By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2) The Service

Send Fax helps you create and transmit faxes using your iPhone (for example by scanning documents, importing PDFs/images, preparing cover pages, and sending to a fax number).

Sending-only. The Service does not provide receiving (inbound) fax numbers.
Transmission. Fax delivery uses telecom and/or third-party infrastructure and recipient systems.
International sending. Availability and deliverability vary by destination and recipient equipment.
Service changes. We may add, remove, or modify features to improve the Service.

3) Eligibility

You must be at least 13 years old to use the Service (or the minimum age required in your jurisdiction). If you are under the age of majority where you live, you may use the Service only with consent of a parent/guardian.

4) Your Use of the Service

As a condition of use, you agree to:

Provide accurate information when required (e.g., recipient fax number).
Use the Service in compliance with applicable laws and regulations (including anti-spam and communications laws).
Maintain the security of your device and any accounts associated with the Service.

You are responsible for the content you send, ensuring you have the right to fax it, and confirming the recipient fax number is correct.

5) Prohibited use & content

You agree you will not (and will not attempt to):

Use the Service for unlawful, harmful, fraudulent, or abusive purposes.
Send unsolicited bulk faxes (“fax blasting”), spam, chain letters, or advertising where prohibited.
Upload or transmit content that infringes intellectual property rights, privacy rights, or other rights of others.
Transmit malware or content designed to disrupt networks, systems, or devices.
Reverse engineer, decompile, disassemble, or circumvent technical protections of the Service.
Access or scrape the Service via automated means except as permitted by law or with written authorization.

Limits to prevent abuse

To protect the Service and prevent abuse, we may apply technical limits (for example, rate limits) regardless of plan. We may suspend or restrict usage if we detect suspicious or abusive activity.

6) Limited license

We grant you a personal, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes, in accordance with these Terms.

All rights not expressly granted are reserved. The Service, including its software, design, and branding, is protected by intellectual property laws.

7) Subscriptions & payments (auto-renew)

Some features may require an auto-renewing subscription. Prices, billing periods, and available plans will be shown in the app before purchase.

Billing by Apple. Payments are processed by Apple via the App Store. We generally do not receive your full payment card details.
Auto-renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Renewal charge. Your account will be charged for renewal within 24 hours prior to the end of the current period at the selected plan’s price.
Manage/cancel. Manage subscriptions in iOS: Settings → Apple ID → Subscriptions.
Free trials (if offered). If you start a free trial, it may convert to a paid subscription unless you cancel before it ends.
Refunds. Refund requests (if any) are handled according to Apple’s policies and applicable law.

We do not offer pay-per-fax credits under these Terms unless explicitly stated in the app at purchase time.

8) Suspension & termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, pose a risk to the Service or others, or if required by law.

Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive (e.g., disclaimers and limitation of liability) will survive.

9) Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

No guaranteed delivery. Fax delivery depends on recipient systems and third-party networks. We do not guarantee successful delivery.
Accuracy. You are responsible for confirming recipient fax numbers and document accuracy before sending.
Third-party outages. We are not responsible for downtime or failures caused by telecom providers or recipient equipment.

Regulated / sensitive data

Unless you have a separate written agreement with us stating otherwise, the Service may not be suitable for processing regulated data (for example, HIPAA “Protected Health Information” in the U.S.) where special compliance obligations apply.

10) Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of (or inability to use) the Service, or from any unauthorized access, use, or alteration of your transmissions or content.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid (if any) to use the Service in the prior 12 months.

11) Third-party services & links

The Service may rely on or link to third-party services (e.g., cloud storage import providers, telecom/fax infrastructure, analytics). We do not control third-party services and are not responsible for their content, policies, or practices.

12) Changes to the Service/Terms

We may update the Service and these Terms from time to time. We will update the “Effective date” above when changes are made. If changes are material, we will provide reasonable notice (for example, within the app).

Your continued use of the Service after changes become effective means you accept the updated Terms.

13) Additional terms applicable to iOS devices

Apple is not a party. Apple is not responsible for the Service and has no obligation to provide support for it.
App Store rules. Your use must comply with the App Store terms and applicable Apple guidelines.
Third-party beneficiary. Apple (and Apple’s subsidiaries) are third-party beneficiaries of these Terms and may enforce them.
